1. Acceptance of Terms By accessing or using VelocityTier’s website, hosting services, VPS, dedicated servers, or any related products, you agree to be bound by these Terms of Service. If you do not agree to these terms, you must not use our services.
2. Description of Services VelocityTier provides premium cloud hosting, VPS, dedicated servers, domain registration, and related services. We strive to deliver reliable, high-performance hosting with excellent uptime. However, we do not guarantee uninterrupted, error-free, or completely secure service.
3. Account Registration and Responsibilities You must be at least 18 years of age. You agree to provide accurate, complete, and current information during registration and to keep your account details updated. You are solely responsible for maintaining the confidentiality of your login credentials and for all activities conducted under your account.
4. Payment and Billing Services are billed in advance. Invoices are sent prior to the renewal date. Failure to pay by the due date may result in suspension of services after 5 days and termination after 10 days. All payments are non-refundable except where explicitly stated in our Refund Policy. We reserve the right to change renewal rates with notice.
5. Suspension and Termination We may suspend or terminate your services immediately if you:
- Violate these Terms of Service or our Acceptable Use Policy
- Fail to make timely payments
- Engage in activities that harm our network, other customers, or our reputation
You may request cancellation of your services through the client portal at any time.
6. Data Ownership and Backups You retain full ownership of all content and data you upload. However, you are solely responsible for backing up your own data. While we may provide backup services, we do not guarantee the availability, integrity, or successful restoration of backups. We are not liable for any data loss.
7. Promotional Offers Promotions, discounts, and coupons are valid for new customers only unless otherwise stated. Abuse of promotions may result in account suspension or termination.
8. Privacy Your use of our services is governed by our Privacy Policy. We do not sell your personal data to third parties.
9. Indemnification You agree to indemnify and hold harmless VelocityTier, its officers, employees, and affiliates from any claims, damages, losses, or expenses arising from your use of our services or violation of these Terms.
10. Limitation of Liability To the maximum extent permitted by law, VelocityTier shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill. Our total liability shall not exceed the total amount paid by you in the thirty (30) days prior to the claim.
11. Force Majeure VelocityTier is not responsible for any failure or delay caused by events beyond our reasonable control, including natural disasters, power outages, strikes, or internet disruptions.
12. Governing Law These Terms are governed by the laws of the State of Maryland, United States. Any legal disputes shall be resolved exclusively in the courts located in Maryland.
13. Changes to Terms We reserve the right to update these Terms at any time. Continued use of our services after changes constitutes your acceptance of the updated Terms.
14. Entire Agreement These Terms of Service, together with our Acceptable Use Policy, Privacy Policy, and any applicable service agreements, constitute the entire agreement between you and VelocityTier.
